Your Content: You retain ownership of content you submit to the Platform. By submitting content, you grant 1Commerce a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Platform.

Our Content: The Platform and its original content, features, and functionality are owned by 1Commerce and are protected by international copyright, trademark, and other intellectual property laws.

6. Transactions Between Users

1Commerce provides a platform for buyers and sellers to connect and negotiate. We are not a party to any transactions between users. Users are solely responsible for the terms of their transactions, including price, quality, delivery, and payment. 1Commerce does not guarantee the quality, safety, or legality of items listed or the accuracy of listings.

7. Fees and Payment

Certain features of the Platform require payment of fees. All fees are stated in your membership agreement or service order. Fees are non-refundable unless otherwise specified. We reserve the right to change our fees upon reasonable notice.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

IN NO EVENT SHALL 1COMMERCE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR ACCESSING THE PLATFORM IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless 1Commerce and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any rights of another.

11. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Platform will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
